§ 53199 Contingent Assessment Enforcement Remedies

Key Takeaways

  • •The law gives multiple ways to collect money owed (like fines or fees).
  • •If one way to collect money doesn’t work, they can try another way.
  • •The money collected can be used to pay for the cost of collecting it, if allowed.
  • •All ways to collect money stay in effect until the full amount is paid.

Example

A city fines a business for breaking rules, but the business refuses to pay.

The city can try different ways to get the money, like taking it from the business’s bank account or selling their property. If one way doesn’t work, they can try another. They can also use some of the collected money to pay for the cost of collecting it.

§ 53199 Contingent Assessment Enforcement Remedies

Remedies for collecting and enforcing the contingent assessments and penalties are cumulative and may be pursued alternatively, or consecutively, as determined by the legislative body. If any one of the remedies is or may be invalid, all valid remedies shall remain effective until the contingent assessments and penalties have been fully collected and the terms of any reimbursement agreement have been satisfied. The costs of collection and enforcement of the remedies for the collection of the contingent assessments and penalties may be paid from the proceeds collected from the contingent assessments and penalties if the legislative body so provides, and if that payment does not violate the terms of any reimbursement agreement. (Added by Stats. 1986, Ch. 1512, Sec. 1.)
