§ 38501 Park Land Abandonment Rules

Key Takeaways

  • •The city can stop using land as a park and sell it if the land hasn't been used as a park by the public.
  • •The city can only do this if no public money was spent to improve the land as a park.
  • •This applies to land that was either set aside or bought to be a park but isn't being used as one.

Example

There's an empty lot in the city that was supposed to be a park, but no one ever built swings or picnic tables there, and no one uses it as a park.

The city can decide to sell this land because it was never really used as a park, and the city didn't spend money to make it into one.
