§ 37356 Alley Passageway Permits

Key Takeaways

  • •The city can allow people to build things like tunnels or bridges over or under public alleys to connect buildings.
  • •These structures must not block traffic or make it hard for people to use the alley.
  • •The city can set rules for how these passageways are used.
  • •The permission to build these can be taken away if needed.

Example

A store owner wants to build a bridge over an alley to connect their two shops on either side.

The city can say yes, but the bridge can't block cars or people walking in the alley. The city can also make rules, like only letting customers use the bridge during store hours. If the bridge causes problems, the city can make the owner remove it.

§ 37356 Alley Passageway Permits

When the legislative body determines that the public interest or convenience requires the construction and maintenance of passageways or other structures under or over any public alley in the city, to connect buildings located on abutting property and facilitate the public use of the streets, it may grant revocable permits for their construction and maintenance. They shall be constructed and maintained so as not to interfere with public traffic on the alley. The city may regulate the use of such passageways or structures. (Added by Stats. 1949, Ch. 79.)
