§ 22775 Family Member Definition

Key Takeaways

  • •Family members include your spouse or domestic partner and your kids (even adopted, step, or recognized natural kids).
  • •The rules set an age limit for kids to be counted as family members.
  • •Your ex-spouse or ex-domestic partner is not considered a family member.

Example

If you work for a company and want to add your stepchild to your health insurance.

The company must let you add your stepchild because the law says stepkids count as family. But if you try to add your ex-husband, they can say no because exes aren’t family under this rule.
