§ 21168 Workers' Compensation Appeals Review

Key Takeaways

  • •If you lose a case with the Workers’ Compensation Appeals Board, you can ask a higher court to check if they made a mistake.
  • •You have 30 days after they say no to your request for a redo (or 30 days after they fix their decision if they agree to redo it).
  • •You can go to the Supreme Court or a closer appeals court where you live.
  • •This is just to check if the board followed the law, not to start the whole case over.

Example

You got hurt at work, and the Workers’ Compensation Appeals Board said you don’t get money for your injury. You asked them to look at your case again, but they still said no.

You have 30 days to ask a bigger court (like the Supreme Court) to check if the board did things the right way. The bigger court won’t decide if you deserve money—they’ll just make sure the board followed the rules.
