§ 19762 Prohibited Payments For Violations

Key Takeaways

  • •You can't get paid for a job if you got it by breaking the rules.
  • •If someone knowingly pays you for that job, they have to pay the money back.
  • •The person who approves the wrong payment can be personally responsible for it.

Example

A manager hires their friend for a job even though their friend doesn’t qualify, and then pays them a salary.

The friend shouldn’t get paid because they didn’t follow the rules to get the job. The manager who approved the payment might have to pay the money back themselves.
