§ 1775 Filling State Officer Vacancies

Key Takeaways

  • •If a big government job is empty (like the school boss or money manager), the Governor picks someone to fill it.
  • •The Senate and Assembly must say 'yes' to the Governor's pick. If they don’t say 'yes' or 'no' in 90 days, the pick gets the job anyway.
  • •If the 90 days end when the Senate and Assembly are on break, they get 6 more days after they come back to decide.
  • •While waiting for a new person, the second-in-command (like the assistant) does the job.

Example

The boss of all schools in the state quits suddenly.

The Governor picks a new boss. The Senate and Assembly have 90 days to agree. If they don’t answer in time, the new boss starts working anyway. Until then, the assistant boss does the job.

In the event the nominee is neither confirmed nor refused confirmation by both the Senate and the Assembly within 90 days of the submission of the nomination, the nominee shall take office as if he or she had been confirmed by a majority of the Senate and Assembly; provided, that if such 90-day period ends during a recess of the Legislature, the period shall be extended until the sixth day following the day on which the Legislature reconvenes. After a vacancy has occurred in an office specified in this section and prior to the time such vacancy is filled as provided in this section, the chief deputy to the above constitutional officers shall discharge the duties of the office.
