§ 31112 Referral Criminal Proceedings

Key Takeaways

  • •If someone breaks a rule under this law, the boss (commissioner) can tell the local lawyer (district attorney) about it.
  • •The local lawyer can then decide to take the person to court for breaking the rule.
  • •The boss doesn’t have to tell the lawyer, but the lawyer can still act if they find out about the rule-breaking.

Example

A company dumps toxic waste into a river, breaking environmental rules.

The boss in charge of these rules can tell the local lawyer about it. The lawyer can then take the company to court, even if the boss didn’t say anything.
