§ 6707 Kelp Lease Royalty Payments

Key Takeaways

  • •If you lease a kelp bed, you must pay at least $40 per square mile every year upfront.
  • •This $40 payment is like a credit—it gets taken off what you owe for the kelp you harvest that year.
  • •You also have to pay a royalty for every ton of kelp you take, and it can’t be less than the minimum set by the law.
  • •If you don’t pay the $40 on time, you could lose your lease.

Example

A company leases 2 square miles of kelp bed to harvest kelp.

They must pay $80 upfront ($40 per square mile) at the start of the year. If they harvest 10 tons of kelp, they’ll owe royalties for those 10 tons, but the $80 they already paid will be subtracted from that bill. If they don’t pay the $80 on time, they could lose their lease.
