§ 219 Regulation Supersession Authority

This law lets the wildlife commission create temporary rules that can change the fishing and hunting code, but only for specific reasons and for up to a year.

Key Takeaways

  • •Rules can only be made to protect fish, wildlife, or natural resources, or during an emergency.
  • •The commission must write down the reasons for the rule when it is adopted.
  • •Such rules can only stay in effect for a maximum of 12 months.

Example

A sudden disease is found in a lake that could wipe out the fish population.

The commission can quickly adopt a rule that limits or stops fishing in that lake to protect the fish, even if it changes the usual fishing limits.
