§ 8704 Citrus District Consolidation Process

Key Takeaways

  • •If the leaders think it's a good idea, they can combine two citrus growing areas into one bigger area with 'consolidated' in its name.
  • •The new big area gets all the money, property, and debts from the smaller areas.
  • •The smaller areas still exist in name only to help with leadership and collecting money for their own needs.
  • •The leaders of the new big area are also the leaders of the smaller areas inside it.

Example

Imagine two small lemon farms next to each other, each with their own leaders and money.

If the leaders think it's better, they can combine the two farms into one big farm called 'Big Consolidated Lemon Farm.' The new big farm gets all the money and tools from the small farms, but the small farms still have a say in how things are run and can collect their own money for their needs. The leaders of the big farm are the same as the leaders of the small farms.

§ 8704 Citrus District Consolidation Process

If the board of supervisors determines that the consolidation is feasible and for the best interests of the citrus growers of the respective districts, it shall by resolution duly adopted declare the districts consolidated into one district, giving the consolidated district a name which name shall include the term “consolidated.” Certified copies of the resolution shall be filed with the Secretary of State and, for record, with the county recorder of each county in which is located any part of the consolidated district. Upon the filing, the districts are consolidated into a single consolidated district with all the rights, privileges, and powers of a district. The consolidated district shall succeed to all the funds and other property, and is subject to all the indebtedness, bonded and otherwise, of the districts consolidated. Each district which is included in the consolidated district shall continue in existence for the purpose of representation on the board of the consolidated district, and for the purpose of levying, assessing, and collecting assessments for district purposes. The board of the consolidated district is, however, the board of each district which is included in the consolidated district. (Amended by Stats. 1989, Ch. 904, Sec. 30.)
