§ 78925 Wine Trade Secret Protection

Key Takeaways

  • •Secret business info (like special recipes or sales numbers) given to the commission is kept private and can't be shared unless a court says so.
  • •Even if the commission or another group finds out secret info, they can't tell anyone unless a court makes them.
  • •General info (like total sales or total shipments) that doesn't show individual details can be shared.
  • •The commission decides what's secret. If they say no to sharing, they must explain why, and you can complain to the secretary if you disagree.

Example

A winery gives the commission their secret grape-growing method so they can get help from the government.

The commission can't tell anyone else about this secret method unless a judge says they have to in a court case. If someone asks for this info, the commission can say no and must explain why. If the person is unhappy, they can complain to the secretary.
