§ 74653 Home Winegrape Processing Exemption

Key Takeaways

  • •This rule doesn’t apply if you’re making wine at home just for yourself.
  • •If you want this exception, you have to tell the government how you’re using the grapes.
  • •The government decides if you really qualify for the exception.

Example

If you grow grapes in your backyard and make wine just for your family to drink at home.

You don’t have to follow the usual rules, but you must fill out a paper saying you’re only using the grapes for your own wine. The government checks if that’s true.

This chapter does not apply to winegrapes processed only for a vintner’s home use. However, any vintner claiming this exemption shall file an affidavit with the commission establishing the manner in which the winegrapes are used. The commission shall then determine whether the exemption applies. (Added by Stats. 1986, Ch. 1287, Sec. 3.)
