§ 72107 Producer Assessment Liability

Key Takeaways

  • •If you're a farmer (producer), you must pay the assessment (a fee) for your products.
  • •Even if the person who buys from you (handler) doesn’t pay the fee to the commission, you still have to pay it.
  • •The fee is like your personal bill—you can’t avoid it just because someone else didn’t do their part.

Example

A dairy farmer sells milk to a company, and the company is supposed to collect a small fee from the farmer to give to the state. But the company forgets to pay the fee.

The farmer still has to pay the fee themselves, even though the company messed up. It’s like if your friend was supposed to pay for your movie ticket but didn’t—you still owe the money.

§ 72107 Producer Assessment Liability

Any assessment which is levied as provided for in this chapter, is a personal debt of every producer so assessed. Failure of a handler to make payment of the collected assessment to the commission shall not relieve the producer of this obligation. (Added by Stats. 1982, Ch. 891, Sec. 1.)
