§ 6299 District Dissolution Petition Process

Key Takeaways

  • •If a lot of landowners in a special district (like a water or fire district) want to shut it down, they can ask the county board to do it.
  • •They need either 50% of the owners who have 65% of the land OR 65% of the owners who have 50% of the land to sign a petition.
  • •The county board must hold a meeting about it within 20-40 days after getting the petition.
  • •If most of the board members vote 'yes,' the district gets shut down.

Example

A group of farmers in a small water district are unhappy with how it’s run and want to dissolve it.

If at least 50% of the farmers who own 65% of the land (or 65% of the farmers who own 50% of the land) sign a petition, the county must hold a meeting. If the county board votes yes, the water district is shut down.
