§ 61345 Milk Production Regulation Framework

Key Takeaways

  • •This law is part of a bigger set of rules about milk production and handling.
  • •All the different parts of these rules work together, but each part can stand on its own.
  • •If one part of the law is found to be invalid or unconstitutional, the rest of the law still applies.

Example

Imagine a rulebook for a school's science fair. The rulebook has different sections for different parts of the fair, like rules for projects, rules for judging, and rules for prizes.

If one rule, like the one about prize money, is found to be unfair and is removed, the rest of the rules about projects and judging still apply. This law works the same way—if one part is removed, the rest still count.

§ 61345 Milk Production Regulation Framework

(a) Chapter 2 (commencing with Section 61801), Chapter 2.5 (commencing with Section 62500), and Chapter 3 (commencing with Section 62700) shall be liberally construed as being complementary of, and supplemental to, this chapter, and these chapters shall constitute a single comprehensive scheme for the regulation of the production and handling of milk and related educational and research activities. However, each of the chapters, and each article, section, subdivision, sentence, clause, and phrase of each chapter is severable. (b) If one of the chapters or any article, section, subdivision, sentence, clause, or phrase of any one of the chapters is for any reason held void, invalid, or unconstitutional, the decision shall not affect the validity of any other chapter or any of its articles, sections, subdivisions, sentences, clauses, or phrases. (Amended by Stats. 2016, Ch. 260, Sec. 6. (AB 1894) Effective January 1, 2017.)
