§ 58785 Marketing Order Assent Period

Key Takeaways

  • •The director must listen to evidence about how long it takes to collect, check, and count written agreements (assents) for a marketing order.
  • •After the hearing, the director decides how much time is needed for this process and sets a deadline for receiving these agreements.
  • •The director tells everyone the deadline when sending out the agreement forms.
  • •If the director thinks more time is needed, they can extend the deadline.

Example

Farmers are asked to agree to new rules about selling their milk.

The director holds a meeting to hear how long it will take farmers to send back their agreement forms. The director then sets a deadline for when these forms must be returned. If the director sees that farmers need more time, they can push the deadline back.

§ 58785 Marketing Order Assent Period

At each public hearing upon a marketing order or a major amendment to it, the director shall receive evidence relative to the period of time which may be necessarily required for the filing, checking, and tabulating of written assents which are prescribed in Article 12 (commencing with Section 58991) of this chapter. He shall also, at the conclusion of each such hearing, make a finding, based upon the evidence, with respect to the period of time which may be reasonably and necessarily required for such filing, checking, and tabulating. On the basis of such finding, the director shall fix and limit the period during which such assents may be received by him and shall be the period at the time of mailing of assent forms to producers and handlers that are affected. If, however, the director finds that an extension of such period is reasonably warranted, he may extend such period for receiving assents. (Enacted by Stats. 1967, Ch. 15.)
