§ 55650 Processor Lien Release Conditions

Key Takeaways

  • •If someone owes you money and you have a claim on their stuff, they can show the court they have enough money or security to cover what they owe.
  • •The court might then let them keep or get back their stuff, and you might not get paid from selling that stuff.
  • •Even if this happens, you can still try other ways to get your money.

Example

Imagine you fixed someone's car, but they didn’t pay you. You have a claim on their car until they pay.

They can go to court and show they have enough money saved or security to cover what they owe you. The court might let them keep the car, and you won’t get paid by selling it. But you can still try to get your money another way, like taking them to court again.

§ 55650 Processor Lien Release Conditions

Such processor may also, on motion duly noticed, introduce evidence to the court before whom any such action is pending to the effect that he has sufficient security or money on deposit with the director to protect the lien or other rights of plaintiff. If he does so, the court may order the release of a portion or the whole of such product upon which the lien of plaintiff is attached, and deny to plaintiff any recovery in such action. Such action by the court does not, however, prejudice any other rights or remedies which are possessed by the plaintiff. (Enacted by Stats. 1967, Ch. 15.)
