§ 5435 Foreclosure Sale Proceeds Distribution

Key Takeaways

  • •After a property is sold due to unpaid debts, the money from the sale first goes to pay off the debt, penalties, and costs.
  • •If there's extra money left after paying the debt, it goes to the property owner if they can be found.
  • •If the owner can't be found, the extra money is held by the court until the owner is found.

Example

Imagine you owe money on your house and it gets sold to pay off the debt.

The money from the sale first pays off what you owe. If there's money left, you get it back if they can find you. If not, the court keeps it safe until you claim it.
