§ 16443 Attorney General Enforcement Actions

This law lets the Attorney General sue in state court to stop anyone who breaks the rules, either after a complaint from the director or on his own if he thinks a violation happened.

Key Takeaways

  • •The Attorney General can act on a director's complaint or on his own if he believes a rule was broken.
  • •The lawsuit must be for an injunction and follow the civil procedure rules in Chapter 3, Title 7, Part 2.
  • •The director does not have to prove lack of other legal remedies or irreparable damage when the case is filed.

Example

The state environmental director says a factory is dumping waste illegally. The Attorney General files a court case to order the factory to stop the dumping.

Because the director complained, the Attorney General can bring an injunction in superior court to make the factory follow the rules, without having to prove the factory will cause irreparable harm.

The director shall not, however, be required to allege facts necessary to show or tending to show lack of adequate remedy at law or to show or tending to show irreparable damage or loss.
