§ 18221 Attorney General Enforcement Actions

This law lets the state's top lawyer file a lawsuit to stop someone from breaking a rule or regulation.

Key Takeaways

  • •The Attorney General can sue if the director complains or if he decides a violation happened.
  • •The lawsuit can ask a court for an injunction to stop the violation.
  • •The director does not need to prove lack of other remedies or irreparable harm.

Example

A local factory is dumping waste into a river, which violates an environmental rule. The director complains, and the Attorney General files a lawsuit to order the factory to stop.

The lawsuit asks a court to issue an order that stops the factory from polluting, and the director doesn't have to prove extra things like that there's no other way to fix the problem.
