§ 14650 Fertilizer Theft License Suspension

If you have a license to sell fertilizers and you knowingly sell stolen or illegally obtained fertilizer, your license will be suspended for at least 18 months.

Key Takeaways

  • •License suspension lasts at least 18 months for knowingly selling stolen fertilizer.
  • •The rule only applies if the license holder actually knew the fertilizer was stolen.
  • •If an employee sells stolen fertilizer and the boss didn't know, the boss's license is not automatically suspended.

Example

A garden store owner buys fertilizer that was stolen from a warehouse and sells it to customers.

Because the owner knew the fertilizer was stolen, a court can suspend the store's fertilizer license for a minimum of 18 months.
