§ 103 Department Conduct Governance

This law says that the rules in Chapter 2 of the Government Code also control this department, just as if those rules were written right here, and the word “head of the department” in those rules means the secretary.

Key Takeaways

  • •Chapter 2 rules apply to this department as if they were part of this code.
  • •The department follows those rules in every respect.
  • •When the other chapter mentions the “head of the department,” it is talking about the secretary.

Example

The Government Code’s Chapter 2 says the department head must sign off on a new hiring plan. Under this law, the secretary has to sign that plan because “head of the department” means the secretary.

Even though the rule is in a different part of the law, it works the same way for this department, and the secretary does the job the rule talks about.
