§ 2213 Voter Registration Cancellation Lawsuit

Key Takeaways

  • •Anyone can ask a court to remove someone’s voter registration if it was done illegally or if something happened later that means they shouldn’t be registered anymore.
  • •If the person whose registration is being challenged isn’t part of the case, the court can add them to it.
  • •The county elections official and others involved can be included in the same case.

Example

Someone finds out their neighbor voted in two different states in the same election.

A person can go to court and ask to cancel the neighbor’s voter registration because voting twice is illegal. The court can make the neighbor part of the case to explain why their registration should stay or be removed.
