§ 18503 Employer Election Violation Fines

This law says that if an employer breaks the rules in Section 14004, they can be fined up to $10,000 for each election they messed up.

Key Takeaways

  • •The fine is up to $10,000 for each election broken.
  • •The state (Secretary of State or a public prosecutor) can sue to collect the fine.
  • •The total fine grows with the number of elections the employer violates.

Example

A company forgets to give workers the required voting materials for three different union elections.

Because they broke the rule for three elections, the state can fine them up to $30,000 (3 times $10,000).

How to Calculate

Fine = $10,000 × N

  1. Count how many elections the employer violated (N).
  2. Multiply that number by $10,000.
  3. The product is the maximum civil fine the employer could owe.

Employer violated 4 elections.

Result: $40,000
