§ 18104 Voter Registration Affidavit Return

This law says that if you are in charge of registration papers and you knowingly refuse or forget to give them back, you can be charged with a misdemeanor.

Key Takeaways

  • •You must return affidavits of registration when asked.
  • •Knowing you are not returning them can lead to a misdemeanor charge.
  • •The county elections official must report the offenders to the district attorney, who can take civil or criminal action.

Example

A local political group keeps voter registration forms and does not return them to the elections office when asked.

Because they knew they should return the papers but chose not to, they could be charged with a misdemeanor, and the elections official must tell the county district attorney who can then sue or press criminal charges.
