§ 14274 Ballot Marking Device Use

This law says that in elections where some ballots are counted by hand and others by machines, you can use the same marking tool for both kinds of ballots.

Key Takeaways

  • •Works only when an election uses both manual and machine counting.
  • •The same marking device (like a pen) can be used for both types of ballots.
  • •No extra marking tools are required for the different counting methods.

Example

A town holds an election where the downtown precinct uses a voting machine to count ballots, while the rural precinct counts ballots by hand.

The same pen that workers use to fill in the machine‑read ballots can also be used to fill in the hand‑counted ballots, so they don’t need a different pen for each method.
