§ 10735 Catastrophic Vacancy Mail Ballots

This law says that after a big disaster that creates many empty seats in the U.S. House, the county must mail out requested ballots within 15 days and set rules for when those ballots must be postmarked and returned.

Key Takeaways

  • •If a disaster creates 101 or more vacant House seats, mail ballots must be sent out within 15 days of the Speaker’s announcement.
  • •If a disaster creates at least one‑fourth of California’s House seats vacant (but fewer than 101 total), mail ballots must be sent out within 15 days of the Governor’s proclamation.
  • •Mail ballots must be postmarked by Election Day and received within 45 days of mailing.
  • •Deadlines for counting and certifying results can be extended by the Secretary of State when needed.

Example

A massive earthquake wipes out several congressional districts in California, leaving at least 101 House seats empty.

The county elections official has to mail out any requested mail‑in ballots within 15 days after the Speaker announces the vacancies, and those ballots must be postmarked by Election Day and returned within 45 days of being mailed.
