§ 72401 Community College Volunteer Aides

Key Takeaways

  • •Anyone can volunteer to help out at a community college without getting paid, as long as they are supervised by teachers or staff.
  • •Volunteers cannot replace paid workers. If a paid job is cut, volunteers can't take over that job.
  • •Volunteers can only do extra work to help the school, not do the work of paid employees.

Example

A community college needs help organizing books in the library.

The school can ask for volunteers to help with this task, but they cannot fire the paid library worker and use volunteers instead.

(a) Notwithstanding any other provisions of law, any person may be permitted by the governing board of any community college district to serve as a nonteaching volunteer aide under the immediate supervision and direction of the academic personnel of the district to perform noninstructional work that serves to assist the academic personnel in the performance of teaching and administrative responsibilities. A nonteaching volunteer aide shall not be an employee of the district, and shall serve without compensation of any type or other benefits accorded to employees of the district, except as provided in Section 3364.5 of the Labor Code. (b) No district may abolish any of its classified positions and utilize volunteer aides, as authorized herein, in lieu of classified employees who are laid off as a result of the abolition of a position. A district shall not refuse to employ a person in a vacant classified position and use volunteer aides in lieu thereof.
