§ 45289 Provisional Appointment Limits

Key Takeaways

  • •If there's no list of qualified people for a job, bosses can hire temporary workers for up to 90 days at a time.
  • •These temporary hires can work more than 6 months in a year if the job keeps needing them.
  • •Once a list of qualified people is ready, the temporary worker can't stay longer, even if their 90 days aren't up.
  • •This rule overrides other hiring rules if they disagree with it.

Example

A school needs a janitor but doesn't have a list of approved candidates yet.

The school can hire a temporary janitor for 90 days. If they still need them after that, they can keep hiring them for another 90 days, even if it adds up to more than 6 months in a year. But once the school gets a list of approved janitors, the temporary one has to leave, even if their 90 days aren't finished.
