§ 27201 Termination Of Creditable Service

Key Takeaways

  • •If you're in a retirement plan, you must stop working for any employer covered by the plan before you can get your retirement money.
  • •Your employer has to confirm you've stopped working, unless you quit more than a year before asking for your retirement money.
  • •Retired people doing small jobs for their old workplace don’t count as working for this rule.

Example

A teacher works for a school district and is part of their retirement plan. She decides to retire and wants to start getting her retirement money.

Before she can get her retirement money, she must stop teaching completely. Her school district has to confirm she’s no longer working there. If she quits teaching in January but waits until December of the next year to ask for her money, the school doesn’t need to confirm because it’s been more than a year.
