§ 17498 School Property Disposition Agreements

Key Takeaways

  • •Schools can make special deals with certain groups (like cities or parks) for their extra land instead of just selling or leasing it.
  • •They can lease the land with an option for the group to buy it later.
  • •They can let the group use part of the land for parks or recreation forever.
  • •If the group can change zoning rules, the school can make them promise to change the zoning of the school’s leftover land in a certain way (if it follows state laws).

Example

A school has extra land they don’t need. The city wants to use part of it for a park and maybe buy the rest later.

The school can make a deal with the city to lease the land for 10 years. The city can use part of it as a park forever, and if they want, they can buy the land after 10 years. The school can also make the city promise to change the zoning of the leftover land to fit what the school wants (as long as it’s legal).
