§ 16318 School Property Disposal Rules

This law says the board tells schools how to sell or handle property that’s being replaced, and the money from that sale must be used to lower the school’s share of the project costs.

Key Takeaways

  • •The board writes rules on how replaced property must be sold or handled.
  • •Following those rules is required before the district gets its share of the project.
  • •Money from the sale goes toward reducing the district’s portion of the project cost.
  • •The board can take the property title and sell it any way it thinks will get the most money.
  • •The district must do whatever the board says to make the sale happen.

Example

A school district has to replace an old gym. The board orders the district to sell the old gym building.

The district follows the board’s instructions, sells the gym, and the cash from the sale is used to cut down the amount the district has to pay for the new gym project.

The board shall prescribe instructions specifying the manner in which property, real or personal, being replaced through the apportionment, shall be disposed of, and compliance with the instructions shall be a condition upon the making of the apportionment. The net proceeds derived from the disposition shall be contributed in reduction of any apportionment proportionate to the state’s participating in the project. Any school district affected shall comply with instructions prescribed by the board. The board may require a district to transfer to the state by any instruments deemed appropriate by the board, title to the property, whereupon, the board shall dispose of the property in any manner it deems appropriate to insure the highest return to the state, and apply the applicable proceeds therefrom in reduction of apportionments to the district. The district affected shall do all things deemed necessary by the board to implement the disposition. (Repealed and added by Stats. 1996, Ch. 277, Sec. 2. Effective January 1, 1997.
