§ 10873 Employee Background Check Requirements

This law says any group that handles private data must send fingerprint and background info of all staff, volunteers, and contractors who could see that data to the Justice Department, and they must make sure any new contracts also require those background checks.

Key Takeaways

  • •Fingerprint and background info must be sent for anyone who might see confidential, personal, health, or financial data.
  • •Contracts made after July 1 2021 must include a clause that forces contractors to run the same background checks on their staff.
  • •The Justice Department passes the request to the FBI, reviews the results, and sends a response back; a fee may be charged for processing.

Example

A city health department hires a new IT technician who will work on computers that store patients' medical records.

The department has to send the technician’s fingerprint and background details to the Justice Department, and any contract they sign with a third‑party IT firm must also say that the firm will run background checks on its own workers who will see the records.
