§ 28950 Good Faith Compliance Protection

Key Takeaways

  • •If you follow the rules or instructions given by the commissioner or the Attorney General, you won’t get in trouble, even if those rules change later.
  • •This protection only works if you truly believed you were doing the right thing by following those rules.
  • •It doesn’t matter if a court later says the rule was wrong—you’re still safe if you followed it in good faith.

Example

A business owner follows a state rule about how to dispose of waste, but later the rule is changed and the old way is now illegal.

The business owner won’t get fined or punished because they were following the rule at the time and didn’t know it would change.
