§ 25700 Good Faith Compliance Protection

Key Takeaways

  • •If you follow the rules or orders given by the commissioner or Attorney General, you won’t be punished, even if those rules change later.
  • •This protection only works if you acted in good faith (meaning you honestly tried to follow the rules).
  • •It doesn’t matter if the rule or order is later found to be wrong or invalid—you’re still safe if you followed it.

Example

A restaurant owner follows a health rule from the government about how to store food. Later, the rule is changed, and the old way is no longer allowed.

The restaurant owner won’t get in trouble for following the old rule as long as they did it honestly and correctly at the time.
