§ 16110 Severability Of Provisions

This law says that if any part of this chapter is found to be illegal or not work, the rest of the chapter still stays in force.

Key Takeaways

  • •If one part of a law is declared invalid, the whole law does not automatically disappear.
  • •Courts can cut out the bad part and let the rest of the law work.
  • •The chapter is written so each section can stand on its own.

Example

A city passes a rule that says everyone must wear helmets while biking and also says they must wear helmets while driving cars. A court decides the driving‑helmet part is impossible, but the biking‑helmet part is fine.

Because of this law, the court can throw out the impossible driving‑helmet rule but keep the biking‑helmet rule alive.

If any provision of this chapter or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this chapter that can be given effect without the invalid provision or application, and to this end the provisions of this chapter are severable.
