§ 4407 Bank Payment Error Recovery

Key Takeaways

  • •If a bank pays money from your account by mistake (like after you told them to stop or closed the account), they can try to get that money back.
  • •The bank can step into the shoes of the person who got the money to get it back from them.
  • •This only happens if the bank would lose money because of their mistake.
  • •The bank can’t take more money than they lost.

Example

You close your bank account on Friday, but the bank accidentally pays a check from that account on Monday.

The bank can try to get that money back from the person who got paid. They can use the same rights that person had to get the money, but only enough to cover what the bank lost.
