§ 2717 Buyer'S Damage Deduction Right

Key Takeaways

  • •If someone buys something and the seller breaks the deal, the buyer can tell the seller they are going to keep some of the money they owe.
  • •The buyer can keep enough money to cover the problems caused by the seller not following the deal.
  • •This only works if the buyer tells the seller they are going to do this.

Example

You buy a new bike online, but when it arrives, the brakes don’t work. The seller refuses to fix it or send a new one.

You can tell the seller you are keeping some of the money you were going to pay them to cover the cost of fixing the brakes yourself.
