§ 10515 Lessee Acceptance Of Goods

This law says that when you rent something, you are considered to have accepted it if you keep it after you’ve had a chance to check it, or if you don’t properly reject it. It also means that if you accept part of a set, you accept the whole set.

Key Takeaways

  • •You are deemed to have accepted the goods if you keep them after a reasonable inspection.
  • •Simply using or not rejecting the goods can count as acceptance.
  • •Accepting any part of a commercial unit means you accept the entire unit.

Example

You rent a washing machine, look it over, and decide to keep it even though it has a small defect.

Because you kept the machine after you could have returned it, the law treats you as having accepted the whole machine, so you can’t later claim it’s defective.
