§ 2211 Space Flight Liability Warning

A company that takes people on space flights must have each passenger sign a warning that explains they can't sue the company for most injuries and that they understand the risks.

Key Takeaways

  • •Passengers must sign a written warning that lists the risks and says they accept them.
  • •The warning must include a notice about limited civil liability under California law.
  • •If the company doesn't provide this warning, it can't claim the immunity protection in section 2212.
  • •The rule doesn't change the state's public policy.

Example

A tourist books a ride on a private rocket to see Earth from space.

The company gives the tourist a paper that says they understand they could be hurt or die, that they are doing it at their own risk, and that they can talk to a lawyer first. If they don't sign, the company can't use the legal protection that shields it from lawsuits.
