§ 1698 Diversion Program Record Destruction

Key Takeaways

  • •If someone finishes a special program for professionals (like doctors or nurses) and shows they’ve changed, all records about their time in the program get deleted.
  • •No one can see or ask for the records about someone’s treatment in the program—it’s private.
  • •The only exception is if another law (Section 1695.5(f)) says it’s okay to share.

Example

A nurse makes a mistake at work because of stress and joins a program to get help. After finishing the program, they prove they’re doing better.

All records about the nurse’s time in the program get wiped clean, and no one can dig them up later. It’s like it never happened.
