§ 10500 Mineral And Gas Brokerage

You can't do any buying, selling, leasing, loan work, or rent collection for mineral, oil, or gas property for money unless you have a proper broker license.

Key Takeaways

  • •Only people with a mineral, oil, and gas broker license or a real estate broker license can do these jobs for money.
  • •The prohibited jobs include selling, buying, leasing, negotiating loans, collecting rent or royalties, and helping with government-owned mineral property.
  • •There are special exceptions listed elsewhere (like Section 10131.4), but otherwise the rule applies.

Example

Jane asks her neighbor to help sell a piece of land that has oil rights, promising to pay him a fee for the work.

Because Jane's neighbor is not a licensed mineral, oil, or gas broker, the law says he is breaking the rule by trying to sell the property for a fee.
