§ 7279 Patient Care Payment Responsibility

Key Takeaways

  • •If someone is in a state mental hospital and has money or property, their guardian must use that money to pay for their care.
  • •The guardian must pay for the hospital stay after paying for the person's basic needs and other important bills.
  • •If the guardian doesn't pay, the hospital can ask a judge to make them pay.
  • •The judge's order to pay must be followed, just like any other court order.

Example

John is in a state mental hospital, and his uncle is his guardian. John has some savings from his job before he got sick.

John's uncle must use John's savings to pay for his hospital stay, but only after paying for things like John's food and rent if he had any. If the uncle refuses to pay, the hospital can go to court, and the judge will order the uncle to use John's savings for the hospital bills.

§ 7279 Patient Care Payment Responsibility

If any person committed to a state mental hospital has sufficient estate for the purpose, the guardian or conservator of the person’s estate shall pay for the person’s care, support, maintenance, and necessary expenses at the state hospital to the extent the estate is available after taking into account essential living expenses and other financial liabilities. The payment may be enforced by the order of the judge of the superior court where the guardianship or conservatorship proceedings are pending. On the filing of a petition therein by the department showing that the guardian or conservator has failed, refused, or neglected to pay for that care, support, maintenance, and expenses, the court, by order, shall direct the payment by the guardian or conservator. The order may be enforced in the same manner as are other orders of the court. (Amended by Stats. 2022, Ch. 47, Sec. 63. (SB 184) Effective June 30, 2022.)
