§ 23105 Reckless Driving Injury Penalties

If you drive recklessly and seriously hurt someone else, the law lets a judge send you to jail, fine you, or do both.

Key Takeaways

  • •Reckless driving that causes any of the listed injuries can lead to jail time, a fine, or both.
  • •The listed injuries include loss of consciousness, concussion, broken bones, serious wounds, disfigurement, brain injury, paralysis, and long‑term loss of function.
  • •Even if this law is used, the driver can still be charged under other laws for the same act.

Example

A driver speeds through a red light and hits a cyclist, causing the cyclist to break a leg.

Because the driver’s reckless driving caused a bone fracture (one of the listed injuries), the driver can be sentenced to 30 days‑6 months in county jail, a fine of $220‑$1,000, or both.
