§ 774 Fire Protection Liability Limits

Key Takeaways

  • •Water companies that help with fire protection can't be sued if they fail to provide enough water or pressure during a fire.
  • •Workers of these companies also can't be blamed if something goes wrong while they're doing their job.
  • •This protection doesn't apply if the company or worker did something worse than what a government worker would do in the same situation.
  • •The rules from the government about water and fire safety still must be followed.

Example

A fire starts in a neighborhood, and the water pressure from the hydrants is too low to put out the fire quickly. A house burns down.

The water company can't be sued just because the water pressure wasn't strong enough, as long as they weren't more careless than a government worker would be.

Nothing in this section shall preclude the enforcement of any rule, regulation, or order of the commission. (Added by Stats. 1972, Ch. 663.)
