§ 7005 Utility Relocation Agreement Recourse

Key Takeaways

  • •This rule only applies if the government and a utility company (like electric, water, or cable TV) have a written agreement about moving utility lines or equipment.
  • •If the utility company stops the work because they don’t have enough money or for another reason, the government can step in.
  • •The government can only take over the work if the agreement says they can do this if the utility company quits.

Example

A city and a cable TV company agree in writing to move cable lines underground for a new road. The cable company starts the work but runs out of money and stops.

If the agreement says the city can take over if the cable company quits, then the city can finish moving the cables. If the agreement doesn’t say that, the city can’t step in.
