§ 50162 Eminent Domain Utility Relocation

Key Takeaways

  • •The government can take private property if they need it for public projects, like building roads or parks.
  • •If they take your property, they must pay you for it and also cover the cost to move or rebuild things like utility lines or buildings.
  • •They can’t take property in a city or county unless the local government agrees to it first.

Example

The government wants to build a new highway and needs to use land where a small shop and some power lines are located.

The government can take the land for the highway, but they must pay the shop owner for the land and also pay to move the power lines to a new spot. They also need the city or county to say it’s okay first.
