§ 50121 Labor Representation Dispute Resolution

Key Takeaways

  • •If workers and bosses can't agree on who should represent the workers, the State Conciliation Service steps in to decide.
  • •The State Conciliation Service will hold a public meeting and may set up a vote to decide who represents the workers.
  • •Once a group is chosen to represent the workers, no one can challenge this choice for at least one year or until the current work agreement ends, whichever is later.

Example

A group of factory workers want a union to represent them, but the factory boss says not enough workers want this.

The workers and boss can't agree, so they go to the State Conciliation Service. The Service holds a meeting and sets up a vote. If most workers vote for the union, the union represents them, and no one can question this for at least a year.

§ 50121 Labor Representation Dispute Resolution

If there is a question whether a labor organization represents a majority of employees or whether the proposed unit is or is not appropriate, such matters shall be submitted to the State Conciliation Service for disposition. The State Conciliation Service shall promptly hold a public hearing and may, by decision, establish the boundaries of any collective bargaining unit and provide for an election to determine the question of representation. Provided, however, any certification of a labor organization to represent or act for the employees in any collective bargaining unit shall not be subject to challenge on the ground that a new substantial question of representation within such collective bargaining unit exists until the lapse of one year from the date of certification or the expiration of any collective bargaining agreement, whichever is later. (Added by Stats. 1963, Ch. 839.)
