§ 30902 Election Proposition Timing Limits

Key Takeaways

  • •If voters say 'no' to a proposal, the same or very similar proposal can't be voted on again for six months.
  • •If 15% of the voters in the area sign a petition asking for another vote, the board can hold a new election sooner than six months.
  • •The 15% is based on how many people voted for governor in the last election.

Example

A school district asks voters to approve a new tax to build a playground. The voters say no.

The school district can't ask the same question again for six months. But if 15% of the voters sign a petition asking for another vote, the school district can hold a new election sooner.

§ 30902 Election Proposition Timing Limits

If any proposition is defeated by the electors, the board shall not call another election on a substantially similar proposition to be held within six months after the prior election. If a petition requesting submission of such a proposition, signed by 15 percent of the district electors, as shown by the votes cast for all candidates for governor at the last gubernatorial election, is filed with the board, it may call an election before the expiration of six months.
